June 2011 Trials:

The trial lawyers at Ellis Boxer & Blake have been busy.  In June 2011, Stephen Ellis secured judgment as a matter of law in favor of his client after four days of jury trial in a multi-party fire loss subrogation case.  Steve's client was the "last man standing" after the court dismissed the other five defendants on various grounds but as Steve was preparing to call his first witness, the court reconsidered its earlier decision on a legal issue that Steve had raised in a motion for summary judgment, and dismissed the case against Steve's client as well.

Also in June, Andrew Boxer defended a traumatic brain injury case before an 11 member jury in Federal District Court in Burlington .  After a week long trial in which virtually every issue was contested, Plaintiff's counsel in closing asked for a $1 million award.  Instead, the jury gave her nothing, finding that Andy's client was not liable for any of plaintiff's claimed injuries.   Andy will be giving a seminar on traumatic brain injury claims at the Vermont Claims Association Fall meeting in Burlington on October 5. Please feel free to call Ellis Boxer & Blake for more information.

Robert Mabey recently received a  favorable decision denying a permanent total disability workers compensation claim that Bob tried several months ago.   Robert  and Wesley Lawrence successfully defended a real estate broker against a claim by a ski resort for website trademark infringement before the World Intellectual Property Organization.

And on to the next campaign . . . . "
